Massacheusetts Drops Flu Shot Mandate

THE DEPARTMENT OF PUBLIC HEALTH HAS OFFICIALLY WITHDRAWN ITS UNJUSTIFIED AND ILLEGAL FLU VACCINE MANDATE FOR ALL STUDENTS!

An ICAN funded lawsuit against the Massachusetts Department of Public Health resulted in it withdrawing its mandate for all students to receive an influenza vaccine. 

On December 18, 2020, a lawsuit and a motion for a preliminary injunction was filed against the Massachusetts Department of Public Health (DPH) challenging the legality of a flu shot vaccine mandate for all children in childcare and all students in school, ages 6 months through 29 years old.

On the same day that the DPH was to file its response to the motion for a preliminary injunction with the Court, the DPH capitulated and withdrew the mandate in its entirety!  The DPH also filed an affidavit with the Court confirming that the flu shot mandate has been formally withdrawn.

This means that NO STUDENT in Massachusetts will be MANDATED to receive the flu vaccine in order to attend school!

This is an enormous and significant victory and a huge relief for thousands of individuals and families across Massachusetts who had been backed into a corner by the DPH’s fiat.
